Amendment of Americans With Disabilities Act Title II and Title III Regulations To Implement ADA Amendments Act of 2008

On August 11th, the Federal Register made available for public inspection a final rule revising the Justice Department’s Americans with Disabilities Act (ADA) Title II and Title III regulations to implement the requirements of the ADA Amendments Act of 2008 (ADAAA). The final rule will be published in the Federal Register tomorrow, August 11, 2016, and will take effect on Monday, October 10, 2016, 60 days from publication in the Federal Register. In response to several Supreme Court decisions that narrowly interpreted the ADA’s definition of “disability,” Congress passed the ADAAA to ensure that the ADA definition of “disability” would be broadly construed. The ADAAA made a number of significant changes to the meaning and interpretation of the ADA definition of “disability” to ensure that the term would be applied without extensive analysis, so that all individuals with disabilities could receive the law’s protections. The final rule ensures that the Department’s regulations are consistent with the changes Congress made to the ADA. A pre-publication copy of the final rule posted by the Federal Register on its public inspection desk can be found today at the Federal Register Once the final rule is published in the Federal Register tomorrow, a copy will be available on the Department’s ADA website. For more information about the ADAAA, please visit the Department’s ADA website www.ADA.gov website or call the ADA Information Line Voice: 1-800-514-0301; TTY: 1-800-514-3083.

DSA Announces the Project Type for the October 2016 Open Book CASp Exam

The project type for the Open Book portion of the Certified Access Specialist (CASp) examination on October 12, 2016, is a Title II Seaside Recreation Area and Community Recreation Center. As previously announced, starting with the October 2016 exam, the CASp exam will include test questions related to the provisions of the recently published 2016 California Building Standards Code. An updated List of Reference Materials is available.
Details on the next CASp examination are as follows:

October 12, 2016 — Sacramento and Los Angeles (Hawthorne)
• Open Book — Check in begins at 7:30 a.m.
• Closed Book — Check in begins at 12:30 p.m.

Registration closes on September 12, 2016.
You can register for this exam through your CASp Account Login.

ADA Coordinator Conference– Plano, Texas October, 18-19, 2016

This 2 day event will be held at the Capital One Regional Campus . The conference will offer a variety of sessions and feature speakers from the U.S.Department of Justice, EEOC, and other nationally recognized ADA experts. Registration is open to the public. In addition, ACTCP members will have an opportunity to obtain both foundation and elective level credits towards their program completion. Seating is very limited.
